What happened
On August 18, 2026, Gov. Josh Shapiro signed Executive Order 2026‑05, tightening Pennsylvania’s data‑center permitting rules.
The order bars projects from the state’s Permit Fast Track Program, prohibits nondisclosure agreements, and requires the Department of Environmental Protection to publish a public map of all known data‑center permits. State permits can now be issued only after developers demonstrate compliance with local plans and obtain all municipal approvals.
Projects that meet the Governor’s Responsible Infrastructure Development (GRID) standards receive rolling state review; those that do not must first secure all local permits. The order also cites the Pennsylvania Environmental Rights Amendment, potentially opening new constitutional litigation.
