New Zealand Sets Regulatory Pathway for White and Orange Hydrogen

The Coalition Government has agreed to regulate white and orange hydrogen under the Natural Environment Act, mirroring the framework used for geothermal resources. Resources Minister Shane Jones and RMA Reform Minister Chris Bishop said the move gives industry, iwi, hapū, landowners and communities clearer rules for ownership and management. The Crown will manage access but will not own the resources, and authorisations can be granted on an exclusive basis to protect investors from competing claims. The decision follows a 2025 public consultation that highlighted strong demand for certainty and protection of Māori interests. Detailed policy work will continue on allocation, royalties and benefit‑sharing, with amendment legislation expected in 2027 once Cabinet finalises the approach.
